5. Acceptable Use Policy

You agree to use SmartViewServer services only for lawful purposes and in accordance with these Terms. The following activities are strictly prohibited:

• Illegal Activities: Using our services for any activity that violates local, national, or international law, including but not limited to fraud, identity theft, or the distribution of illegal content
• Spam & Unsolicited Communications: Sending unsolicited bulk email, spam, or any form of unauthorized mass communication from our servers
• DDoS Attacks: Launching, facilitating, or participating in Distributed Denial of Service (DDoS) attacks or any other form of network attack against any target
• Malware Distribution: Hosting, distributing, or facilitating the distribution of malicious software, viruses, trojans, or any harmful code
• Copyright Infringement: Hosting or distributing copyrighted material without proper authorization from the rights holder
• Resource Abuse: Using server resources in a manner that negatively impacts other customers or the overall network performance
• Unauthorized Access: Attempting to gain unauthorized access to any systems, networks, or data belonging to SmartViewServer or any third party

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without prior notice or refund.

6. Service Level Agreement

SmartViewServer is committed to providing reliable and high-performance hosting services. We guarantee a 99.9% network uptime for all VPS hosting services, measured on a monthly basis. This guarantee is subject to the following conditions:

• The uptime guarantee applies to network availability and does not cover scheduled maintenance windows, which will be communicated in advance whenever possible
• The guarantee does not apply to downtime caused by factors outside our reasonable control, including but not limited to natural disasters, acts of war, government actions, or failures of third-party services
• The guarantee does not apply to downtime resulting from customer actions, misconfigurations, or violations of these Terms
• Service credits may be issued at our discretion for verified downtime that falls below the guaranteed threshold

7. Limitation of Liability

To the maximum extent permitted by applicable law, SmartViewServer and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of our services, regardless of the cause of action or the theory of liability.

In no event shall SmartViewServer's total aggregate liability to you for all claims arising out of or related to these Terms or your use of our services exceed the total amount paid by you to SmartViewServer during the twelve (12) months immediately preceding the event giving rise to the claim.

SmartViewServer does not guarantee that our services will be uninterrupted, error-free, or completely secure. You acknowledge that you use our services at your own risk and that you are solely responsible for maintaining backups of your data.

8. Termination of Service

Either party may terminate the service relationship as follows:

• By the Customer: You may cancel your services at any time through your client area or by contacting our support team. Cancellation will take effect at the end of the current billing period
• By SmartViewServer: We reserve the right to suspend or terminate your account immediately and without prior notice if you violate these Terms, fail to make timely payments, or engage in activities that pose a risk to our infrastructure or other customers

Upon termination, your access to all services and data associated with your account will be revoked. SmartViewServer is not obligated to retain or provide copies of your data after termination. It is your responsibility to back up all data before cancellation or termination.

9. Intellectual Property

All content, trademarks, logos, service marks, and intellectual property displayed on the SmartViewServer website and within our services are the property of SmartViewServer or their respective owners. You may not reproduce, distribute, modify, or create derivative works from any of our intellectual property without our prior written consent.
